Gütersloh (dpa/tmn) – Ihr Arbeitgeber hat Ihnen een Bonuszahlung-zugesagt and will this nun plötzlich kürzen or gar streichen? It was likely that the Arbeitnehmern Frust failed, but that is often not the case. Johannes Schipp, Fachanwalt für Arbeitsrecht, erläutert die Rechtslage.

Bonuses are as a rule one of the best Leistung or Ziele knüpft. If you pose a sister-tlich view, the regulation of the problem is not possible. What matters: Arbeitnehmer has given an answer to the bonus, when the vereinbarte Leistung has been brought. “Then the worker cannot see that bonus at night, but it seems that the regulations are in the nachhine-kürzen or zurückfordern-könnte,” says Schipp.

Stichtagsklauseln often work out

For a number of Arbeitsverträgen it is good basic regulations. This time the Arbeitnehmer loses a bonus, if there is a best date, December 1 is expected to be no longer in another country. It is often the case that Klauseln hinders, the Worknehmer kurz nach der Bonusauszahlung-kündigen.

Solche Vereinbarungen have aber Boundaries. The Federal Labor Court (BAG) launched the ship in a major undertaking in July 2024, while Klauseln in some cases has undergone an unangemessene delivery for the Arbeitnehmer darstelling and so dismantling.

Bonus cannot be obtained

And was it a passion if the Arbeitgeber would make a proposal for the bonus zahlungen when launching a project? This is the ship that deals with the following: “If any of the bonuses are a bonus, it’s the trade, and it can’t have a bedside table anymore.” So, there is an answer to the start date.
