HC bench recuses itself from hearing ex-cop Sachin Waze’s plea for bail | India News

A bench of the Bombay High Court on Tuesday decided not to entertain a petition filed by dismissed police officer Sachin Waze seeking bail in the CBI corruption case involving former Maharashtra Home Minister Anil Deshmukh.

Waze, who is in custody, had sought bail, claiming that he approves of the case and that he has been granted bail on an equal footing with the other suspects.

A bench of Justices Bharati Dangre and Manjusha Deshpande had earlier this month briefly heard the petition and said they would first pass an order on the anticipatory bail application and then take up the petition for final consideration.

However, on Tuesday, Judge Dangre declined to hear the case.

“I did not realise then that this case also involves Anil Deshmukh. I cannot hear any arguments in this,” Justice Dangre said without elaborating.

The petition will now be submitted to another chamber for consideration.

Waze argued in his petition that keeping him in jail even after he was cleared was a violation of fundamental rights.

The Central Bureau of Investigation (CBI) opposed the request, stating that Waze had not yet given a statement in the case and that it would not be in the interest of the case to release him on bail.

The former police officer was declared an approver by the special CBI court in June 2022.

Waze was arrested in March 2021 for his alleged role in the case of an explosives-laden vehicle found near industrialist Mukesh Ambani’s residence in south Mumbai and the murder of Thane businessman Mansukh Hiran.

In April 2021, the Supreme Court directed the CBI to conduct a preliminary inquiry into allegations of corruption and misuse of power levelled against Deshmukh by former police chief Param Bir Singh.

Based on this investigation, the investigating agency registered an FIR against Deshmukh, his associates and Waze.

Singh alleged that Deshmukh, then Home Minister, had directed police personnel to collect Rs 100 crore monthly from restaurants and bars in the metropolis.

He also alleged that Waze, which was earlier suspended following allegations in an alleged fake encounter case, had been reinstated and was collecting funds on Deshmukh’s behalf.

The other suspects in the case are Deshmukh’s former aides, Sanjeev Palande and Kundan Shinde. All three have been released on bail.
